Status of unemployed person

According  to the Law on Support for the Unemployed and Employment-seekers, rights to the status of unemployed person are entitled to persons who have registered in the State Employment Agency (SEA) have and:

  • do not work (are not considered as employee or self-employed person according to the Law on State Social Insurance);
  • are seeking a job;
  • are capable of working and ready to start working immediately;
  • are at least 15 years old;
  • has not reached the age providing rights to receive state retirement pension or state retirement pension is not granted (also prematurely);
  • not enrolled in primary or secondary school education, full-time program;
  • are not engaged in entrepreneurial activity or their entrepreneurial activity has been suspended in compliance with the normative acts;
  • is not fully maintained by the state.

Persons with disability are considered as able-bodied.  Except for those persons with disability having 100 percent loss of capacity for work as established by the State Medical Commission for the Assessment of Health Condition and Working Ability.

Unemployed persons can register in any local office of the SEA regardless of the declared place of residence. In order to register for acquiring the status of unemployed person a person must submit an application for acquiring the status of unemployed person and produce the following documents in the SEA:

  • identity card or passport or travel document;
  • documentary evidence for residence permit in the Republic of Latvia if a person must hold them;
  • Form U2 if the unemployed person has worked in any of European Union member states, European Economic Area country or Swiss Confederation.

Decision about conferring the status of unemployed person if the person complies with all the criteria stipulated in the Law On Support for the Unemployed and Employment-seekers and produced the above mentioned documents is made by the SEA within 1 working day.  

If person has fallen ill in the registration day, SEA confers the status of unemployed person after the person has recovered.

The status of unemployed person can be lost if:

  • for the uncertain period or more than 2 months the person has acquired the status of employee or self-employed person according to the Law On State Social Insurance  except for the case of involvement in active employment;
  • has reached the age providing rights to receive state retirement pension or state retirement pension is granted (also prematurely);
  • person enrolled in primary or secondary school education full-time program;
  • the person has enrolled in the secondary or vocational school except for the night school;
  • the person has twice turned down an appropriate job offer;
  • the person has not properly fulfilled the responsibilities of unemployed person without providing plausible reason;
  • the person has given false data necessary for acquiring and keeping the status of unemployed person;
  • the person has moved to permanent residence outside the European Union unless otherwise stipulated for Latvia in the international law
  • the person has 100% loss of capacity for work;
  • the person has been renewed at job by the court adjudgement; 
  • the person has died;
  • the person has refused from the status of unemployed person by submitting a respective application to the SEA.

Decision about the loss of unemployed person status is made by the SEA within 1 working day after the respective causes are established in compliance with the Law On Support for the Unemployed and Employment-seekers. In such case a person loses unemployed person status since the day the respective condition for losing the said status has set in.

Rights to repeatedly acquire the status of unemployed person but no sooner than 3 months after the day of loosing the status of unemployed person are entitled to the person who:

  • has twice turned down an appropriate job offer
  • has not properly fulfilled the responsibilities of unemployed person without providing plausible reason;
  • has given false data necessary for acquiring and keeping the status of unemployed person;
  • refused from the status of unemployed person by submitting the respective notice to the SEA
