In Latvia the legal framework for posting of workers is set by the Labour Law. By this legal framework the Directive 96/71/EC of the European Parliament and of the Council of 16 of December 1996 concerning the posting of workers in the framework of the provision of servicesas well Directive (EU) 2018/957 of the European Parliament and of the Councul of 28 June 2018 amending Directive 96/71/EC concerning the posting of workers in the framework of the provision of services.

All issues concerning the posting of workers are subject to the Labour Law, including also such related issues as work remuneration, working time and rest time, prohibition of differential treatment, etc. However, issues related to occupational health and safety are subject to the Labour Protection Law and a number of regulations issued by the Cabinet of Ministers. Issues that are related to reimbursement of an official travel expenses are subject to special regulations of the Cabinet of Ministers.

The provisions of the Labour Law concerning the posting of workers apply to the employers within the European Union and the European Economic Area.

However, several issues related to the posting of workers are also applicable to third-country nationals employed in Latvia in the context of an intra-corporate transfer in accordance with the requirements of the Directive 2014/66/EU of the European Parliament and of the Council of 15 May 2014 on the conditions of entry and residence of third – country nationals in the framework of an intra-corporate transfer.
